‘CONSTITUTION OF THE MAHASU MITRA MANDAL’
CHAPTER-I
Article-1
(A) Name: The body shall be known ‘THE MAHASU MITRA MANDAL’ hereinafter referred to as M.M.M. or Mandal.
(B) Headquarter: The Registered office of the Mandal shall be located at SOLAN (Himachal Pradesh).
Article-2
(A) This document may be called Constitution of ‘The Mahasu Mitra Mandal and its jurisdiction shall be confined to Solan.
(B) “Solan” means Solan Town and its periphery.
Article-3
‘AIMS AND OBJECTIVES’
The aims and objectives of the Mandal shall be as delineated below:
(A) To foster the spirit of solidarity, co-operation, unity and develop the feelings of fraternity among its members.
(B) To safeguard and promote the interests and privileges of the members.
(C) To render timely succour and extend the needed co-operation to members on various occasions.
(D) To provide financial assistance for the welfare and development of women, children and youths.
(E) To initiate programmes and work for restoration and sustenance of ecological balance and environment.
(F) To provide facilities and financial assistance to the needy persons and meritorious students for higher education and research.
(G) To organise, arrange and carry on all such lawful social and cultural activities as are conducive to promote the above objectives.
Article-4
Every member of the Mandal undertakes to contribute to the assets of the Mandal in the event of its being wound up which he/she is a member or within one year afterwards, for the payment of debts and other liabilities of the Mandal contracted before he/she ceases to be a member and the costs, charges and expenses of winding up and the adjustments of the rights and contributors among themselves. Such amount as may be required shall not exceed Rs. 100.00 only.
Article-5
The income and property of the Mandal be appropriated solely towards the promotion of aims and objectives of the Mandal. No remuneration or salary shall be given by the Mandal to any member or office bearer except the payment of actual expenses incurred on travelling etc; payable to the members associating themselves with work of the Mandal or any payment made in good faith to any officer, servant of the Mandal in lieu of the services rendered to the Mandal.
Article-6
For dissolution of the Mandal, a resolution be moved by the Executive Committee in the General House and the Mandal shall stand dissolved if it is approved by ¾ majority of the members present and voting in the General House or by the specially convened meeting of the General House.
CHAPTER-II
Article-7
(A) The Mandal or M.M.M. shall be registered body (M.M.M.) not for profit under the Registration of Societies Act, 1860.
(B) The name of the Mandal shall be ‘THE MAHASU MITRA MANDAL’ hereinafter referred to as Mandal or M.M.M. shall be located at Solan (Himachal Pradesh).
Article-8
‘MEMBERSHIP’
The membership shall be open to:-
(A) Bonafide residents of UPPER SHIMLA ZILLA (i.e. erstwhile Upper Mahasu District) who have settled at SOLAN.
(B) The employees (Public or Private) serving at Solan and who originally hail from UPPER SHIMLA ZILLA.
(C) Those who express intense desire for the enrolment as members may be given membership if:-
(i.) he/she was born in the UPPER SHIMLA ZILLA REGION and whose parents continue to be bonafide resident of the region;
(ii.) he/she has inherent cultural affinities with the region; and
(iii.) he/she is serving or working/residing at Solan.
(D) Founder member shall have the right to retain the membership as per rules of the Mandal, even if he/she ceases to be a resident of Solan on account of one or the other reason.
Provided he/she subscribe to the aim and objectives of the Mandal mentioned in the Memorandum of the Mandal, pledge to abide by the Constitution and decision taken by the Mandal and does not act in manner prejudicial or detrimental to the interest of the Mandal.
Termination of Membership
(A) A person shall cease to be member if he/she fails to pay subscription or tenders his/her resignation to the President of the Mandal or ceases to be the resident of Solan.
(B) Removal: If the member acts in a manner prejudicial to the interests of the Mandal or if he/she misbehaves, the Executive Committee may suspend him and shall recommend to the General House the removal of the delinquent. He/She shall stand removed if his/her removal is approved by the General House by 2/3rd majority votes of the members present and voting.
(C) The Mandal may have a Patron for one year.
(D) Every member shall pay Rs.25/- as enrolment fee and Rs.50/- as annual subscription payable in advance.
(E) The Mandal is authorised to receive donations in kind/cash. The Executive Committee may decide to raise funds by way of special contribution as and when deemed necessary.
Article-9
‘STRUCTURE OF THE MANDAL’
General House
The General House of the Mandal shall consist of all members who have sought membership according to the prescribed rules. It shall be supreme body to which the Executive Committee shall be accountable for its functioning.
Meetings
Ordinarily the meeting of the General House shall be held at least once a year. An extra ordinary meeting may be summoned by the Executive Committee or on the requisition signed by 1/5th of the members to consider the urgent resolution affecting the interests of the Mandal.
Provided a notice of ten days along with the agenda of the meeting is sent to the Secretary of the Mandal for such meeting.
Quorum
The quorum for holding a meeting shall be 1/3rd of the total membership. The meeting shall be presided over by the President.
Powers
The General House shall transact the following business:-
(i.) Adopt/review the Annual Report submitted by the Exective Committee;
(ii.) Elect the office bearers of the Executive Committee;
(iii.) Pass the budget and review the accounts of the Mandal;
(iv.) Amend the constitution;
(v.) Any other important issues referred to it by the Executive Committee.
Article-10
Executive Committee
The Executive Committee shall function as a second supreme body of the Mandal. It shall vested with the power to manage general affairs of the Mandal of M.M.M. in conformity woth the decisions, policy and programme laid down by the General House. It shall consist the following:-
i) President
II) Senior Vice President.
III) Vice President
IV) Secretary
V) Joint Secretary (General Affairs)
V) Joint Secretary (General Affairs)
VI) Joint secretary (Cultural Affairs)
VII) Treasures
VIII) Five Members co-opted by the President.
Tenure
The members/office bearers of the Executive Committee shall be elected for one year by the General House. They shall remain in office till the new office bearers assume office. An office bearer who absents himself/herself for three consecutive meetings of the Executive Meetings without proper intimation and convincing reason shall cease to be its member.
Quorum
The quorum for holding meeting shall consist of 1/3rd of the members of the Executive Committee.
The Executive Committee shall meet as and when deemed necessary at a venue and time fixed by the Secretary in consultation with the president. Notice and agenda shall be sent to every member of the Executive Committee. The President shall preside over the meeting.
Power of the Executive Committee
i) The Executive Committee shall have general control over the finance and shall appoint a qualified auditor to conduct audit of the accounts once a year.
ii) The Executive Committee may recommend amendment of the constitution.
iii) The executive committee may appoint sub-committee(s) to consider certain matters or important affairs relating to the Mandal.
iv) The Executive Committee shall have the powers to formulate rules, regulations and bye- laws for the smooth conduct of the affairs of the Mandal. It shall have also the powers to revoke, repeal and alter rules, regulations and byelaws framed by it.
Article-11
‘FUNCTIONS’
President
The President shall be the principal office-bearer of the M.M.M. He shall perform the functions as delineated below:-
a) He shall preside over the meetings of the general house and Executive Committee and shall regulate the proceedings and confirm and sign the minutes of the proceedings of the meetings.
b) He shall have a casting vote in case of a tie. He shall have no vote otherwise.
c) He shall guide and control the activities of the Mandal.
d) He shall interpret the rules and regulations and his ruling on the contest shall be final.
e) He shall perform such function(s) as may be assigned to him by the General House.
Article-12
Senior Vice-President
a) He shall act and exercise the powers of the president of the M.M.M. in his absence.
b) He shall perform functions relating to the M.M.M., which are assigned to him by the Executive Committee.
Article-13
Vice-President
a) He shall act and exercise the powers of the president of the M.M.M. in his absence of the president and senior Vice-President.
b) He shall perform functions relating to the M.M.M., which are assigned to him by the Executive Committee.
Article-14
Secretary
a) He shall be the Principal Executive Officer of M.M.M. He shall maintain records of the M.M.M. prepare annual reports and keep minutes of the meetings of the General House and the Executive Committee.
b) He shall take action on the resolution passed by the General House and the Executive Committee and report the result thereof to the Executive Committee.
c) He shall incur expenditure up to Rs. 500 with the sanction of the President and shall report expenditure to the Executive Committee in the ensuing meeting.
d) He shall call meeting of the General House and the Executive Committee and shall issue notice and circulate agenda for the meeting at least ten days in advance.
e) He shall carry all the correspondence on behalf of the Mandal or M.M.M.
f) He shall perform any duty assigned to him by the Executive Committee of the M.M.M.
Article-15
Joint Secretary (General Affairs)
a) He shall act and exercise the powers and functions of the secretary in his absence .
b) He shall undertake those functions specifically assigned to him by the Executive Committee from time to time.
Article-16
Joint Secretary (Cultural Affairs)
a) He shall arrange cultural activities in accordance with the decisions of the Executive Committee.
b) He shall act and exercise the powers and functions of the secretary in his absence of the Secretary and Joint Secretary (General Affair).
c) He shall undertake those functions specifically assigned to him by the Executive Committee from time to time.
Article-17
Treasurer
a) The Treasurer shall be responsible for the payments of the bills with the approval of the President/Secretary.
b) He shall secure receipts and maintain proper accounts of the funds, receipts and payments.
c) He shall receive money contribution, enrolment fee etc.
d) He may keep a sum of Rs. 200 as imprest money.
e) He shall get the account books and other records scrutinised by the Executive Committee.
f) He shall put the annual report of the account before the General House for approval.
g) In the absence of the Treasurer, the President in consultation with the Executive Committee, may assign the work of the Treasurer to the Secretary or any one of the Joint Secretaries of the M.M.M.
Article-18
Funds
a) All cash of the M.M.M. except the imprest money shall be deposited by the Treasurer in the scheduled bank in consonance with the decision of the Executive Committee.
b) The Secretary and the Treasurer shall oprate the accounts jointly
Article-19
Audit
a) The accounts of the M.M.M. shall be audited by a competant auditor appointed by the Executive Committee.
b) The accounts, after having got audited along with the annual report shall be laid before the General House every year for its approval.
Article-20
Amendment
An amendment to the constitution of the M.M.M. shall be initiated by the Executive Committee in the form of a resolution and such amendment shall be deemed to have passed if the said resolution approved by a majority of not less than 2/3rd members present and voting in the General House.
Provided that such meeting is attended by not less than half members of the M.M.M. A proper notice of ten days for such meeting should be given.
Certified to be true and correct copy of the rules, regulations and constitution of 'THE MAHASU MITRA MANDAL' with its head office at SOLAN (Himachal Pradesh).
